Accommodation Terms and Conditions 2

  • Terms and Conditions for Overnight Stay
    Scope of application
    Article 1
    1. The accommodation contract and related contracts which this hotel enters into with the guest to be accommodated shall be subject to the provisions of these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws, regulations or generally accepted practices.
    2 In cases where the Hotel has entered into a special agreement with a Guest insofar as such special agreement does not violate laws, regulations and customs, notwithstanding the provisions of the preceding paragraph, the special agreement shall take precedence.
    Application for accommodation contract
    Article 2
    A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
    (1) Name of guest,Tel(Or mobile phone number)
    (2) Date of stay and expected time of arrival
    (3) Any other particulars deemed necessary by the Hotel.
    If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph 2 of the preceding paragraph, the Hotel will treat it as an application for a new Accommodation Contract at the time such request is made.
    Personal information obtained by our hotel will be used in accordance with the "Handling of Personal Information".
    Establishment of accommodation contract, etc.
    Article 3
    An Accommodation Contract will be deemed to have been established when the Hotel accepts the application as stipulated in the preceding Article.However, this does not apply if the hotel proves that its consent was not given.
    When an Accommodation Contract has been established in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, limited to the accommodation charges for the entire stay (if the stay exceeds 3 days, for 3 days), shall be paid by the date specified by the Hotel.
    The application fee shall first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remainder, if any, shall be refunded at the time of payment of the accommodation fee as provided for in Article 12.
    If the application fee pursuant to the provisions of Paragraph 2 is not paid by the date specified by the Hotel, the Accommodation Contract will become void.However, this will only apply if the Hotel has so informed the Guest when specifying the due date for payment of the application deposit.
    Special agreements that do not require payment of a deposit
    Article 4
    Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded.
    If the Hotel has not requested the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and/or has not specified the due date for the payment of the application fee when accepting the application for an Accommodation Contract, it will be treated as if the Hotel has accepted a special contract as stipulated in the preceding Paragraph.
    Refusal to enter into an accommodation contract
    Article 5
    The Hotel may refuse to enter into an Accommodation Contract under any of the following cases:

    When the application for accommodation does not conform to these terms and conditions.
    When the Hotel is fully booked and there are no rooms available.
    When the person seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.
    When the person seeking accommodation is deemed to be threatening to disturb the peaceful running of the Hotel by behaving in a violent manner towards Hotel staff or other guests, keeping Hotel staff occupied for an extended period of time or engaging in conduct that interferes with the work of Hotel staff.
    When any of the following applies to the person seeking accommodation:
    (1) Organized crime groups designated under the Law on Prevention of Unjust Activities by Organized Crime Group Members (Law No. 77 of 1991), their members, etc., or related parties, and other antisocial forces (hereinafter referred to as "Organized Crime Groups, etc."))
    (2) A corporation or other organization whose business activities are controlled by an organized crime group or a member thereof
    (3) A corporation whose executive officer is a member of an organized crime group or a member of such a corporation
    When the person seeking accommodation can be clearly recognized as having an infectious disease.
    When a person seeking accommodation makes violent demands or makes excessive demands such as the following:
    (1) Provision of services not offered by the Hotel
    (2) Providing services that violate laws, regulations, or public order and morals
    (3) Requesting a price discount after signing a contract without a valid reason
    (4) Upgrading rooms without a valid reason, or providing meals or other items not included in the contract
    (5) Any other burden that exceeds the reasonable range.
    When the Guest has engaged in abusive language, violence, threats, extortion or fraud against hotel staff or other guests.
    When a Guest posts false information or posts malicious content such as slander against Hotel employees or other guests on social media or message boards.
    When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons.
    When a person requesting accommodation is intoxicated or otherwise likely to cause inconvenience to other guests and/or Hotel employees, or when a person's behavior is such that it causes considerable inconvenience to other guests and/or Hotel employees. (Based on prefectural ordinances)
    When the person seeking accommodation has caused trouble to the Hotel in the past.
    Guest's Right to Cancel Accommodation Contract
    Article 6
    The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
    The Hotel may cancel any provision of the Accommodation Contract due to reasons attributable to the Guest.
  • Guest's Right to Cancel Accommodation Contract
    Article 6
    The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
    When the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which he/she is liable (except when the Hotel has specified a due date for the payment of the application deposit pursuant to the provisions of Article 3, Paragraph 2 and requested such payment, and the Guest has cancelled the Accommodation Contract prior to such payment).) will claim a penalty in accordance with Appendix 2.However, in cases where the Hotel has entered into a special agreement as provided for in Article 4, Paragraph 1, this will only apply when the Hotel has notified the Guest of his/her obligation to pay a penalty when the Guest cancels the Accommodation Contract.
    If a Guest does not arrive by 8 p.m. on the day of the stay without contacting the Hotel (or by two hours after the expected time of arrival if the Guest has stated such time in advance), the Hotel may regard the Accommodation Contract as having been cancelled by the Guest.
    Right to Cancel Hotel Contract
    Article 7
    If the Hotel discovers such a fact after making a reservation or during your stay, the Hotel will refuse to accommodate you at that point.
    (1) When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws and regulations, requests from government agencies or other public authorities, or that will violate the public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
    (2) When the Guest is deemed to be threatening to disturb the peace and order of the Hotel by using abusive language or violence against the Hotel staff, keeping the Hotel staff occupied for a long period of time, or obstructing the work of the Hotel staff.
    (3) When any of the following applies to a person applying for the Accommodation Contract or related contracts or a person using the Hotel:
    1) When the person is a member of an organized crime group, or has a connection with such an organized crime group or other similar group.
    (2) Corporations or other organizations or members whose business activities are controlled by organized crime groups, etc.
    3) A corporation or its members in which an executive is a member of an organized crime group, etc.
    ④ If the guest behaves in a manner that causes significant inconvenience to other guests.
    (4) When the Guest can be clearly recognized as having an infectious disease.
    (5) When violent demands are made in relation to the accommodation, or when the Hotel is asked to assume an unreasonable burden, such as the following:This includes instances when similar conduct has occurred in the past.
    ①Provision of services not offered by the hotel
    ②Provision of services that violate laws, regulations, or public order and morals
    3) Requesting a discount after signing a contract without a valid reason
    ④Upgrading rooms without a valid reason, providing meals not included in the contract, etc.
    ⑤When any employee of the Hotel has been threatened, intimidated or defrauded.
  • ⑥ When posting false information or malicious comments such as slander against hotel employees on social media or message boards
    7) When an intimidating and unreasonable demand is made and a burden is asked that is beyond reason.Or when it is deemed that the individual has engaged in similar conduct in the hotel in the past.
    8. When any act similar to those listed above in ① to ⑦ has occurred.
    (6) When accommodation is no longer possible due to a natural disaster or other force majeure.
    (7) When a person seeking accommodation is intoxicated or otherwise intoxicated and is likely to cause significant inconvenience to other guests, or when such person behaves in a manner that causes significant inconvenience to other guests. (Based on prefectural ordinances)
    (8) When the Guest violates the prohibitions of smoking other than at places designated by the Hotel, smoking in bed, tampering with fire-fighting equipment, or other regulations stipulated by the Hotel.
    When the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, it shall not charge the Guest any fees for any accommodation services etc. which he/she has not yet received.
    Accommodation Registration
    Article 8
    Guests will be required to register the following particulars at the Hotel front desk on the day of their stay:
    (1) The name, age, sex, address, telephone number (or mobile phone number) and occupation of the guest
    (2) For foreigners, nationality, passport number, place of entry and date of entry
    (3) In the case of a foreigner who does not have an address in Japan, in addition to the provisions of the previous paragraph, a copy of the passport
    (4) Departure date and scheduled departure time
    (5) Name of accompanying person
    (6) Any other particulars deemed necessary by the Hotel.
    If the Guest intends to pay the charges prescribed in Article 12 by any means other than currency, such as traveller's cheques, accommodation coupons, credit card, etc., these will be required to be presented in advance at the time of registration prescribed in the preceding Paragraph.
    Room Occupancy Time
    Article 9
    Please refer to the "Check-out" section of the facility's service information for the times when guests can use their hotel rooms.However, if you are staying for consecutive nights, you may use the room all day except on the days of arrival and departure.Even after check-in hours begin, we may have to ask you to wait due to room preparations, etc.
    Notwithstanding the provisions of the preceding paragraph, the Hotel may permit the Guest to occupy the guest rooms outside the hours specified in the same paragraph.In this case, the following additional fees will be charged:
    (1) Until 1:00 p.m., 30% of the basic room rate
    (2) Until 2:00 p.m., 60% of the basic room rate
    (3) After 3:00 p.m.: 100% of the basic room rate
    We may decline your request if we are fully booked.
  • Observance of the rules of use
    Article 10
    Guests are required to observe the "Rules of Use" stipulated in the "Accommodation Contract" while on the premises of the Hotel.
    Opening Hours
    Article 11
    The business details and opening hours of the main facilities of the Hotel will be announced in the pamphlets provided, on notices posted in various locations, and in the guest rooms, etc.
    Business hours may be subject to temporary change when necessary.In that case, we will notify you by appropriate means.
    Payment of fees
    Article 12
    The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
    Payment of accommodation fees, etc. as set forth in the preceding paragraph shall be made at the Front Desk upon request by the Hotel in currency or by any other means acceptable to the Hotel, such as traveller's cheques, accommodation vouchers, or credit card.
    Accommodation charges will be charged even if the Guest voluntarily does not utilize the guest room after the Hotel has provided it to the Guest and made it available for use.
    Liability of the Hotel
    Article 13
    The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements.However, this does not apply when the cause is not attributable to the hotel.
    Our hotel is covered by hotel liability insurance to cover the unlikely event of a fire or other incident.
    Handling when contracted rooms cannot be provided
    Article 14
    When the Hotel is unable to provide a contracted room to a Guest, it will arrange, where possible, for the Guest to stay in accommodation of similar standards elsewhere, with the Guest's consent.
    Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange alternative accommodation, the Hotel shall pay the Guest a compensation fee equivalent to the breach of contract charges, which shall be applied to the reparations.However, if the inability to provide a room is due to reasons beyond the control of the hotel, the hotel will not pay compensation.
    Handling of deposited items
  • Article 15
    The Hotel will compensate the Guest for any loss or damage to any items deposited at the Front Desk by the Guest, except in cases where this has been caused by reasons of force majeure.However, regarding cash and valuables, if the guest has not previously notified the hotel of the type and value, the hotel will not accept any responsibility for the loss or damage of such items, except where such loss or damage is due to the hotel's willful or gross negligence.*We will compensate for such damages (up to a maximum of 150,000 yen).
    If a Guest fails to deposit items, cash or valuables brought into the Hotel at the Front Desk, and such items are lost, broken or otherwise damaged through intentional or negligent acts on the part of the Hotel, the Hotel will compensate for such damages.However, for items for which the guest has not notified us in advance of the type and value, the hotel will not be liable for any damages, except where there is intentional or gross negligence on the part of the hotel.*We will compensate for such damages (up to a maximum of 150,000 yen).
    Our hotel is unable to store artworks, antiques, musical instruments, etc.
    Storage of Guest's Baggage and Belongings
    Article 16
    When the baggage of the Guest is delivered to the Hotel prior to his/her stay, the Hotel will be responsible for storing it only when such request has been approved by the Hotel in advance and will hand it over to the Guest at the Front Desk at the time of check-in.
    When a Guest has checked out and found any baggage or belongings left behind at the Hotel, the Hotel will, in principle, await contact from the owner to ask for instructions.If there are no instructions from the owner, valuables will be turned over to the nearest police station within seven days of the date of discovery, and other items will be disposed of after three months.However, food, drink, tobacco, magazines, items that may be considered a sanitary environment, and other items that are considered waste (items that are obviously broken) will be discarded the next day even if they are still within the storage period.
    The liability of the Hotel regarding the custody of the Guest's baggage and belongings in the cases of the preceding two Paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the preceding Article in the case of Paragraph 2.
    The Hotel may, at its discretion, inspect the contents of any left behind baggage or belongings in order to take appropriate action according to the nature of the items.
    If any costs are incurred in returning any property found at our facility to its owner, these costs will be borne by the owner.
    If a Guest intentionally or accidentally leaves oversized garbage or other personal belongings that require disposal fees in the guest room, common areas or other areas on the Hotel premises, the Guest will be required to pay a disposal fee in accordance with the law, as well as an appropriate amount as the Hotel's agency fee.If it can be objectively inferred that the items were left behind intentionally, or if we have not received any contact regarding your belongings within one week of the check-out date, we will assume that the items were left behind intentionally and that ownership has been abandoned.
  • Parking Responsibility
    Article 17
    Guests may park in the parking lots managed by our hotel (hereinafter referred to as the "Hotel Parking Lot").) and parking lots not managed by the Hotel (hereinafter referred to as "Affiliated Parking Lots").The Hotel shall not be liable for any accidents, theft, etc. occurring within the premises unless such accidents or theft are caused by reasons beyond the control of the Hotel.
    Liability of the Guest
    Article 18
    When the Hotel suffers damage caused through intent or negligence on the part of the Guest, the Guest will compensate the Hotel for such damage.

    Appendix 1 Breakdown of accommodation fees, etc.(Regarding Article 2, paragraph 1 and Article 12, paragraph 1)

    Note 1 The percentage is the ratio of the penalty to the accommodation fee.
    Note 2 In the event that a contract is terminated for part of a group (15 or more people), 10% of the number of guests staying as of 10 days prior to the stay (or the day of acceptance if the application is accepted after that day) (rounded up to the nearest whole number).) there will be no penalty.
    Refusal to enter into a contract for services other than accommodation
    Article 19
    The Hotel may refuse to accept a contract for services other than accommodation under any of the following circumstances:
  • When any of the following applies to a person applying for a contract for the service or a person using the hotel:
    (1) Any entity that is a member of an organized crime group, etc. as defined in Article 5, Paragraph 5
    (2) Anything that is deemed to be in violation of laws, regulations, requests from government agencies, or public order and morals
    When a Guest behaves in a manner that causes significant nuisance to other guests of the Hotel.
    When the Hotel or its employees are requested to assume an unreasonable burden, such as any of the following:
    (1) Provision of services not offered by the Hotel
    (2) Providing services that violate laws, regulations, or public order and morals
    (3) Requesting a discount without justification
    (4) Forcing a party to do something without a legitimate reason, or providing services not included in the contract
    (5) When a hotel employee is subjected to abusive language, violence, delaying behavior (being held up for a long period of time), threats, extortion, or fraud.
    (6) When posting false information or malicious comments such as slander against hotel employees on social media or message boards
    (7) When an intimidating or unreasonable demand is made and a burden is asked that is beyond reason.(If this fact becomes apparent after your reservation or during your use, we will refuse your use at that point.)
    When the Guest violates the Hotel Rules and Regulations.(Including cases where the hotel judges there is a risk of violation.)
    When the Hotel has reasonable grounds to determine that your use of the Hotel is unacceptable.

  • Changes to the accommodation agreement
    Article 20
    The Hotel may, at its discretion, change the Terms and Conditions of Accommodation Contract in the following cases:
    (1) When the change in the Terms and Conditions of Accommodation Contract is in the general interest of the guests.
    (2) When the change to the accommodation terms and conditions is not contrary to the purpose of the accommodation contract and is reasonable in light of the necessity for the change, the appropriateness of the content after the change, the content of the change and other circumstances related to the change.
    When changing the Terms and Conditions of Accommodation Contract pursuant to the preceding paragraph, the Hotel will post a notice of such change, as well as the contents of the changed Terms and Conditions and their effective date on the Hotel's website etc., at least two weeks prior to the effective date of the changed Terms and Conditions.
    Internet communication
    Article 21
    Use of internet communications within the Hotel is at the guest's own risk.The service may be interrupted or terminated without notice due to system failure or other reasons.
    The Hotel shall not be liable for any damage suffered by the Customer as a result of service interruption caused by a system failure during internet communication or for other reasons, unless such damage is due to reasons attributable to the Hotel.If the Hotel determines that your use of internet communications is inappropriate and there is a possibility that it may cause damage to the Hotel or a third party, the Hotel will request that you discontinue use of the relevant service and will require you to compensate for any damages incurred.
    Other
    22nd Article
    In accordance with Fire Service Act, our hotel has installed fire alarms throughout the facility. If the alarm detects a fire or other reason, an announcement may be made within the facility.The Hotel shall not be liable for any damage suffered by customers as a result of this in-facility broadcast.
    For the safety of our guests, if we are unable to contact you for an extended period of time, hotel staff will call you in your room or pester you in front of your room.Furthermore, please understand that if there is no response or in the event of an emergency, the Hotel may be forced to enter your room.
    Please refrain from taking photographs, videos, DVDs or recordings for commercial purposes in the rooms or on the premises without permission.In addition, even if the footage or recordings are for personal use, please do not post them on the Internet or distribute them via social media for commercial purposes without permission.(Including live streaming) In some cases, this may be subject to legal action.
    Please refrain from meeting visitors in your guest room.
    Pursuant to Article 2 of the Accommodation Contract, we will not allow any guests other than registered guests (including accompanying persons) to meet in the guest rooms or allow them to stay overnight.
    When the hotel receives an item delivered to a guest, the hotel shall not be liable for any loss or damage to the item unless the loss or damage is due to reasons beyond the hotel's control.
    We will not accept applications for residence using the address of our hotel facilities as your resident registration.Proof of stay will be provided by the issuance of an "Accommodation Certificate", not a "Residence Certificate".
